Question:
What is defined as Spam?
Answer:
Unsolicited email, also called "Spam", is any email which was not specifically requested by the recipient. HostMySite reserves the right to determine whether or not an email message is Spam based on our Terms of Service and the Federal CAN-Spam act of 2003.
Question:
What is HostMySite's policy on unsolicited email?
Answer:
HostMySite.com does not allow or condone unsolicited email on our network. Our policy strictly prohibits sending any unsolicited or bulk email which does not conform to the standards of the Federal CAN-Spam act of 2003. HostMySite.com will fully investigate any Spam complaints received from legitimate sources and hold accountable those who violate our policy. Upon receiving a Spam complaint, HostMySite.com will take all necessary actions to ensure that the issue is resolved, up to and including termination of all hosting services for the offending party.
Question:
What is a Spam complaint?
Answer:
A Spam complaint is any notification to a network authority that there has been an instance of unsolicited emailing. A complaint can either be sent directly to the domain from where the Spam originated (i.e. abuse@offendingDomainName.com) or to a Spam monitoring agency like SpamHaus or SpamCop. In the HostMySite.com Spam policy, a single Spam complaint will consist of all the Spam reports that originate from one unsolicited emailing. For example, a broadcast message sent to 900 recipients that generates multiple Spam complaints will count as one Spam instance, not as the total number of complaints received.

What about mailing lists? Do you allow bulk mail distribution?
Answer:
We allow mailing lists that comply with the Federal CAN-Spam act of 2003. When determining if a list is Spam, it is more important to consider how the members were added to the list than the total number of recipients. For example, an e-commerce site that sends a newsletter to 20,000 members who all opted into the list is more acceptable than a mailing sent to 100 recipients from a list that was purchased.

What is the purpose of the Spam policy?
Answer:
HostMySite.com is in business because we genuinely care about providing the best hosting experience for our customers. To maintain the integrity of our network, we will take all necessary actions to prevent a small group of users from disrupting service for the rest of our customers. A strong anti-Spam policy raises the level of service and network performance that we can offer our customers.
Question:
What happens when the policy is broken?
Answer:
When a Spam complaint is found to be valid, we will notify the offending party and require them to cease their unsolicited emailing activities and provide written verification of their changes with future steps they will take to avoid further complaints. The specific actions taken are at the sole discretion of HostMySite and could include complete termination of service with no refund.
Question:
Am I responsible for unauthorized use of my email accounts?
Answer:
If a reported Spam complaint is due to a breach of security on your account, we will not hold your account responsible under the condition that you take all necessary actions to remedy the security issue. We will work with you to ensure that the breach of security does not occur in the future.
Question:
Will I be held responsible for unsolicited emails which spoof their 'From:' address as though they come from my domain?
Answer:
Spam messages that falsely indicate that they are from your domain will not be held against your account. Typically, the header information in the email will indicate if the email actually originated from your domain. We will take all necessary actions to erase Spam complaints of this nature.
Question:
How do I report unsolicited email that I receive from HostMySite's network to HostMySite?
Answer:
You can forward the offending email to abuse@hostmysite.com. We will respond to a complaint within 24 hours.
Note: This address is not used to report Spam messages that are delivered to your HostMySite.com email address.
